Overview

Your privacy is important to Article Document, LLC (“Article Document,” “us”, or “we”). This Privacy Policy explains the types of information we may collect through the Article Document websites (“Web Sites”) and the related services offered by Article Document (“Services”), how we may use and disclose the information once it is collected, and, where applicable, how you can stop us from collecting, using, disclosing or continuing to hold your information. We want to ensure that in using any of the Services, you understand the terms of this Privacy Policy, including any subsequent changes made to the Privacy Policy as described in Part 7 below, and are aware of the privacy choices available to you.

Article Document only provides the Services to businesses located in the United States and Canada. Our sales team actively researches prospective businesses that may want to engage our Services. Article Document may reach out to business prospects via email, social media, mail, advertising or by telephone. Article Document does not knowingly target communications to, knowingly process information from, or otherwise seek to engage with, individuals in the European Union. If we contact you and reside in the EU or you would otherwise prefer not to hear from us again, you can opt out of further communications at articledocument.com/unsubscribe.

1. What Types of Information We Collect

When you interact with us through the Services, we may collect information that can be used to identify you such as your name, email address, IP address or phone number and other information from you, as further described below (“Personal Data”):

Personal Data That You Provide Through the Services

We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys or emails, post social media content on your behalf, create or update an account or order, and/or access the Services, or upload a photograph. You are not required to provide Personal Data, but if you do not, we may not be able to provide you the requested Services. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to use a particular service or feature. Under some circumstances, we may require financial information. We use your financial information, including credit card information to verify your name, company name, address, and other information, as well as to bill you for your use of our Services, where applicable. We process personal information on servers in the United States of America. In some cases, we process personal information on a server outside your own country, through a third-party vendor. We may also collect email addresses, company information and social media information through our sales and marketing efforts and customer relationship management systems

Personal Data That You Provide Through the Services

The Services allow you to enable or log in to the Services via various social networking services like Facebook, LinkedIn, or Twitter (“Social Networking Service(s)”). To take advantage of this feature, we will ask you to log into or grant us permission via the relevant Social Networking Service. When you add a Social Networking Services account to the Service or log into the Service using your Social Networking Services account, we will collect relevant information necessary to enable the Service to access that Social Networking Service, including your social media handles and your data contained within that Social Networking Service. As part of such integration, the Social Networking Service will provide us with access to certain information that you have provided to the Social Networking Service, and we will use, store and disclose such information in accordance with this Privacy Policy. However, please remember that the manner in which Social Networking Services use, store and disclose your information is governed by the policies of such third parties, and Article Document shall have no liability or responsibility for the privacy practices or other actions of any Social Networking Services that may be enabled within the Service.

Aggregated Personal Data

In an ongoing effort to better understand and serve the users of the Services, Article Document often conducts research on its writers’, influencers’ and customers’ behaviors, demographics and interests, utilizing or based on the Personal Data and other information provided to us. Article Document may share this complied and analyzed Personal Data with its affiliates, agents, customers and business partners. In order to provide certain functionality associated with our Service, we may collect and use your location information, either on an individual or aggregated basis as described in the section entitled “Aggregated Personal Data”. We may share aggregated non-personal information with third parties.

Non-Identifiable Data

When you interact with Article Document through the Services, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. Article Document may store such information itself or such information may be included in databases owned and maintained by Article Document affiliates, agents or service providers. The Services may use such information and pool it with other information for tracking.

Cookies

In operating the Services, we may use a technology called “cookies.” Our cookies help provide additional functionality to the Services. They also may help us analyze the performance and usage of our Services.

We may allow third party service providers to use cookies or similar technologies such as pixel tags, to collect information about your browsing activities over time and across different websites following your use of the Services. Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Service. Do Not Track Policy

Some web browsers may transmit “do-not-track” (“DNT”) signals to mobile applications with which the user communicates. We currently do not change our tracking practices in response to DNT settings in your web browser.

Our third-party partners, such as web analytics companies and third-party ad networks, may collect information about you and your online activities over time and across our Services and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser and we do not obligate these parties to honor DNT settings. We utilize Google Analytics for our web analytics and you can opt out of your usage data being included in our Google Analytics reports by visiting https://tools.google.com/dlpage/gaoptout.

2. How We Use Your Personal Data

We use your information to provide, personalize, and facilitate the Services you request, resolve disputes, troubleshoot problems, process payments, and enforce our agreements.  We also use your Personal Data for the personalization of our marketing messages, sales outreach and for quality management and audit purposes. We may use your IP addresses for security purposes, such as verifying and/or validating traffic, usage and users of the Web Sites and/or Services. We also use demographic information to verify that you are eligible to use the Services. At times, we may look across multiple users to identify problems or resolve disputes. If you choose to provide us with your credit card information or billing information, we use your address and billing information to bill you and provide associated support. Credit card payments are processed through PandaDoc and Chargebee for the purposes of charging our customers for our subscription services. Chargebee shares your billing information with Plaid (ACH processing), Stripe (credit card processing), Braintree (credit card processing) and Intuit’s Quickbooks Online for data recording. We do not collect or retain any of this information directly in the Article Document platform.

By using the Services, you agree that we may use personally identifiable information about you to improve our marketing and promotional efforts, analyze site usage, improve our content and product offerings, and customize our site’s content, layout, and services. These uses improve our site and better tailor it to meet your needs.

We use third-party advertising companies to serve ads when you visit our website or through written communications. These companies may use information about your visits to this and other websites to provide advertisements about goods and services of interest to you.

You agree that we may use your information to contact you and deliver information to you including targeted banner advertisements, administrative notices, product offerings, and communications relevant to your use of the Web Site. You expressly agree to receive this information. If you do not wish to receive these communications, we encourage you to opt out of the receipt of certain communications at https://www.articledocument.com/unsubscribe/. You may make changes to your notification preferences at any time.

It is our policy not to use or share the Personal Data in ways unrelated to the ones described above without also providing an opportunity to opt-out or otherwise prohibit such unrelated uses.

You may also have the option of posting your Services activities to Social Networking Services when you access content through the Services (for example, you may post to Facebook that you performed an activity on the Service); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity.

3. Additional Terms for Content Creators and Micro-Influencers

For content creators and micro-influencers, we may also collect your social security numbers and/or tax identification numbers, age, gender, educational background, demographic information, information regarding your hobbies and interests, W8-BEN form and Form W-9. We use this information to verify your identity, verify you are old enough to be retained as a content creator or micro-influencer, and issue payments to you for projects completed.

Content creators and micro-influencers that acknowledge that when they connect their social media accounts to the Social Networking Service, you are also granting Article Document consent to review and analyze the information and data posted on your social media accounts to assess your brand value and provide you with targeted content assignments and/or micro-influencer posting offers.

4. Sharing, Selling and Trading of Your Personal Information Collected Online with Third Parties

Article Document does not share, rent, sell or disclose personal information to third parties, except as described in this Privacy Policy. Article Document shares personal information with third party service providers, such as “white label partners,” ACH processing providers, credit card processing companies,  social media networks, customer relationship management systems, analytics solutions, and any other 3rd party partners who help us to deliver and/or secure the Services. Article Document may also share or disclose personal information to third parties as necessary  to comply with a judicial proceeding, legal requirement, court order, or legal process served on Article Document; to investigate possible fraud, identity theft or any other possible crime; in connection with the sale, merger, purchase, liquidation, reorganization or dissolution of Article Document; when we believe it is necessary to protect the safety, rights or property of Article Document or other persons, or as otherwise permitted or required by law. In addition, in order to protect against potential fraud, we may verify with third parties the personal information you provide when you sign up for an account. In the course of such verification, we may receive personal information about you.

Article Document uses Plaid Inc. (“Plaid”) to gather end user’s data from financial institutions. By using our service, you grant Article Document and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy located at https://plaid.com/legal. It should be noted that on some portions of the Web Sites, users can choose to have their Personal Information displayed.

5. Security Pertaining to Your Information

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage, and processing practices, and introducing security measures, including physical security measures, to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to Article Document employees, service providers and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. We use secure socket layer (“SSL”) technology to encrypt and protect the security of your personal information, including but not limited to your credit card number, when it is sent over the Internet. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

6. Data Retention and Deletion

Retention

We process your personal data only as long as necessary to provide you with the  Services and for our legitimate and essential business purposes, such as:

  • maintaining the performance of the Services;
  • making data-driven business decisions about new features and offerings;
  • complying with our legal obligations;
  • resolving disputes.

Deletion

Upon achieving data processing purposes, upon the termination of your account, or upon your request, we’ll delete or anonymise your personal data so it no longer identifies you within 30 days, unless we’re required to keep something or we still need to use it for a legally justifiable reason.

Here are some examples of situations where we’re legally allowed or required to keep some of your personal data:

  • if there’s an unresolved issue relating to your Account, such as an outstanding credit balance, or unresolved claim, or a dispute;
  • for our audit, legal, tax, and accounting obligations;
  • where necessary and to the extent permitted by applicable local, state or national law;
  • for our legitimate interests such as fraud prevention or to maintain security.

Communications Opt-Out

If you prefer not to receive newsletters or other marketing e-mails or paper correspondence from Article Document, please let us know by clicking on https://www.articledocument.com/unsubscribe/ or by sending a request to: Article Document, LLC, Attention: Marketing, P.O. Box 8816, 303 Washington Street, Michigan City, IN 46360 USA. Please be sure to include in any postal mail, your full name, e-mail address, postal address, and any message. Please note that such requests may take up to thirty (30) days to become effective.

7. Miscellaneous

Modification of Personal Information

If your name, e-mail or postal address, telephone number or other personal information changes, you may log in to your account and click “My Profile” or “My Account” to modify your personal information.  You may also update, correct or omit the relevant information by contacting us at Article Document Customer Service, P.O. Box 8816, 303 Washington Street, Michigan City, IN 46360 USA or by visiting our site and clicking Contact Support.

Governing Law and Jurisdiction

This Privacy Policy constitutes a contract made under, and shall be governed by and construed in accordance with, the laws of the State of Indiana, without regard to its conflicts of law principles.

Children’s Issues

The Web Site is not directed to children under thirteen (13) years of age, and children under such age must not use the web site or services offered on it to submit any individually identifiable information about themselves.

Business Transfers

In the event that Article Document sells substantially all of its assets, or one of Article Document ’s business units are acquired, Personal Data and Aggregated Personal Information will likely be one of the transferred assets.

Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Data by Article Document to third parties for the third parties’ direct marketing purposes. Changes to this Privacy Policy

We reserve the right to revise, amend, or modify this Privacy Policy and our other policies and agreements at any time and in any manner. Any revision, amendment, or modification will be posted on the Web Site.
